The purpose of this page is to show just how easy it is to game the DMCA system at Google.  It works like this.

a. File a DMCA against the top 100 pages of your competitor.  List a bunch of other sites as well to ensure it doesn’t look like an attack.
b. Don’t use your own IP or email.  Sign up to a residential proxy service and use for example Igor Valoskies IP in Poland, and create a new gmail to file with.
c. Publish the claimed material on a website you control, and add a date to the page that predates the publish date of the pages you are claiming are breaching copyright.
d. Repeat against other pages, from a different ip, and email, ever week.  Preferably on the day of their highest trading.

Google will not even check, if the pages you claim breach copyright, even exist.
Google will not check, if this is a false claim or not in any way.  They won’t check your ID, they won’t ask for any proof.
Google will not check, if the pages where you claim to publish the image, even do so.

It’s 100% an honor system, and the claimant is believed to be telling the truth.

Now.  If you use Google Search Console ( many don’t) in many cases, you will be notified.  But often not.
You CAN file an appeal, and likely in 14 days you will win, as the claimant must file a legal action after that time.  They won’t file such an action…. but they don’t need to.  They just hit you again the next day with a new DMCA.

Even in the Supreme court if you are seeking an injunction prior to a court ruling, you need to show evidence of a strong Prima Facie case.

In the case of Google DMCA’s you just need to file.  That’s it.  No evidence the page exists, the copyright breach happened, you have the rights to bring the action, or even ID of who you are or what country you are in.

Thousands of sites have to suffer through their top pages being constantly removed from Google, to pop back in for a minute 2 weeks later, only to be subject to a new DMCA.

I blame John  Mueller.  This could be fixed in a day.  “Make photo id a requirement” would stop 99.9% of fake claims.

To prove my point, I am filing one against John today.  It’s 100% malicious, and I am admitting to that here.  Let’s see if it’s still acted upon.
