The purpose of this page is to show just how easy it is to game the DMCA system at Google.\u00a0 It works like this.<\/p>\n

a. File a DMCA against the top 100 pages of your competitor.\u00a0 List a bunch of other sites as well to ensure it doesn’t look like an attack.
\nb. Don’t use your own IP or email.\u00a0 Sign up to a residential proxy service and use for example Igor Valoskies IP in Poland, and create a new gmail to file with.
\nc. Publish the claimed material on a website you control, and add a date to the page that predates the publish date of the pages you are claiming are breaching copyright.
\nd. Repeat against other pages, from a different ip, and email, ever week.\u00a0 Preferably on the day of their highest trading.<\/p>\n

Google will not even check, if the pages you claim breach copyright, even exist.
\nGoogle will not check, if this is a false claim or not in any way.\u00a0 They won’t check your ID, they won’t ask for any proof.
\nGoogle will not check, if the pages where you claim to publish the image, even do so.<\/p>\n

It’s 100% an honor system, and the claimant is believed to be telling the truth.<\/p>\n

Now.\u00a0 If you use Google Search Console ( many don’t) in many cases, you will be notified.\u00a0 But often not.
\nYou CAN file an appeal, and likely in 14 days you will win, as the claimant must file a legal action after that time.\u00a0 They won’t file such an action…. but they don’t need to.\u00a0 They just hit you again the next day with a new DMCA.<\/p>\n

Even in the Supreme court if you are seeking an injunction prior to a court ruling, you need to show evidence of a strong Prima Facie case.<\/p>\n

In the case of Google DMCA’s you just need to file.\u00a0 That’s it.\u00a0 No evidence the page exists, the copyright breach happened, you have the rights to bring the action, or even ID of who you are or what country you are in.<\/p>\n

Thousands of sites have to suffer through their top pages being constantly removed from Google, to pop back in for a minute 2 weeks later, only to be subject to a new DMCA.<\/p>\n

I blame John\u00a0 Mueller.\u00a0 This could be fixed in a day.\u00a0 “Make photo id a requirement” would stop 99.9% of fake claims.<\/p>\n

To prove my point, I am filing one against John today.\u00a0 It’s 100% malicious, and I am admitting to that here.\u00a0 Let’s see if it’s still acted upon.<\/p>\n<\/div>
